Are People Serving Time In Prison Allowed To Draw Social Security?
People that have been convicted of a crime and will be required to serve more than 30 days in prison cannot collect Social Security benefits. This includes people that are required to stay in a state funded facility because they are unfit to stand trial, deemed insane or required to spend time in a halfway house per court order. If the conviction is for less than 30 days the benefits will not be interrupted. This is for any type of Social Security benefit. Once a person becomes a cost or burden to the state, they are no longer qualified to receive state assistance. In many instances, states require any Social Security benefit that was being paid to that person to be paid to the state or prison system to cover the cost of their incarceration.
What happens If I Know Someone Is Receiving Social Security Benefits While In Prison?
If you know that someone is collecting benefits while they are serving time in prison you are obligated to report this information to your local Social Security office. It is against the law for anyone who is serving extended time in prison to receive benefits from the Social Security Administration.
Can Someone Apply For Benefits From Social Security Once They Have Completed Their Sentence?
If a person finishes their sentence and is not required to live in a halfway house for any extended period, they can apply for benefits from the Social Security Administration. However, these ex-prisoners will be required to meet the same requirements as people that have not served time. If there is a work history, their payments will be based on that history and accumulated SS credits. If there is a disability in question, they must comply with all the disability requirements prior to receiving any money.
