How Far Back Is Medicaid’s Look Back Period?

Medicaid rules are extremely complicated. Certain assets count towards one’s eligibility and some do not. Some assets are “liquid” and count towards the $2000 limit and some do not. And any mistakes can quite easily cause one to lose coverage. It is incredibly important to understand the rules and regulations behind Medicaid in order to ensure continued coverage.

What is a look back period?

The Medicaid look back period has to do with gifts that are given to lower one’s assets. Any time that someone gives a reportable gift, with a value in excess of $1000, that asset counts against his or her long-term coverage. The look back period is the amount of time for which the gift counts against coverage.

What assets are considered in a look back period and how long is it?

Part of the confusion with Medicaid rules has to do with the fact that while the law was made by the federal government, it is executed and administered by the various states. Therefore, many things vary from state to state. However, there are some rules that one can rely upon.
First, the look back period is five years for all gifts. The gifts that count are financial gifts in excess of $1000 and other relatively liquid gifts that vary from state to state. This will be most anything that significantly lowers one’s net worth. The penalties on these gifts vary from state to state. In most cases, the penalty is on long term insurance, rather than short term. The value of the penalty is the value of the gift expressed as a percentage of the total cost of monthly care, and one will have to pay this amount towards his or her long-term care.
